We have a new towing company, but do they know the association rules? or maybe I don't know? They came yesterday to our town house, our property and asking my husband to move our car that was parking near our garage? Is it right?It's not a red zone, it's our parking space, we have only 1 car garage. Please explain.

Elevator Problem on 353 Philip Drive building. IMPORTANT, PLEASE READ!
Yesterday, December 27, 2012 at 6:30 PM I and my husband got stuck in the elevator while trying to get to our apartment on the 3 floor. Elevator close the door moved up a little then stopped and left us inside with door closed. That was terrible experience. That is what we find out:
1. While getting stuck inside with door closed - we suddenly find out that there is no contact information inside the elevator to call for help.
- No emergency numbers to call.
- No emergency devices that can be used to let outside world know that you got into trouble. (Just imagine - you don't have your cell phone with you!!!)
- We try to call our management company, manager Jennifer, she was not in the office and there was NO option on her answering system to be re-directed to right person in emergency situation. You just have to leave you message and wait till next morning or till she will get back from her vacation.
Great! Isn't it?

Elevator was NOT working properly for an about 2 or more weeks and just about hour or two before we got stuck, some company was fixing it and has released it for use. What kind of company is that? How they can do this without proper testing and management approval for use?
State of California Permit for using elevator has expired on 10/11/2012. This is more then 2 months ago. I made a pictures of it.
End of story is that we got out of elevator after 1 hour and 10 minutes being locked, fire department came and broke the door after company can't open the door. We've got so lucky to have our friend and neighbor Raisa Lopatina from 303 building. She was able to find the maintenance guy and bring him there, he knew the number to call company that do repair job and fire department. WE also lucky that maintenance person did not get home yet by 6:30 PM.
We also got extremely lucky that we don't have small kids or our 86 years old mam with us that time!!! Some one else may get less lucky...

I'm sharing this terrible experience with everyone in Serramonte Village to support this request and fix those problems as fast as possible. Remember YOU may be NEXT!

Requests:
1. Elevator on 353 and other has to be fixed for good.
2. All the Elevators should have all the emergency information of the repair company that we have contract with and instruction on how to use it.
3. All the Elevators should have all the emergency our management company contacts, manager, maintenance and so on.
4. All the Elevators should have emergency number/option to call while off business hours.

I think it's about time to make some priorities on our spendings as well.
Safety and functional use of our facilities should come FIRST:
- Elevators
- Gates and securities, including security cameras.
- Communication, including electric lines and water.
- Pool and sauna and so on.

And only after that what is left should be spend on look of our complex. I'm not saying that looks is not important, but it's less important and at this time of tight budget we need to make right choices.

On the carbon monoxide flyer, it request us to purchase the devices. The devices are the alarm and as well as the detector?
The website is full of information, but
does not tells us where to call for information, neither who is going to install them.

This information was distributed in August in the newsletter. Unfortunately, the link on the homepage of the website was going to the wrong one. It's correct now, so you should be able to download the newsletter and FAQ. This information was supplied to residents of the Village as a courtesy; but it is up to individual homeowners to install the equipment and make sure they comply with the new law.

Hello,
I would like to report that the sauna in the rec building has not been working for the past few weeks. Given 30-45mins to warm up at full power, it barely even gets hot. It seems that we have spent a lot of money making sure that the buildings are secured with fancy keypads, yet the actual amenities are not kept in working order.

Hello, and thanks for your comments. This was discussed at great length at the board meeting last Thursday night, and is being investigated. If you had been at the meeting, you would have been able to share your knowledge of the problem, which was just then brought to the board's attention.

The "fancy keypads" were merely replacing the old system that no longer worked properly. Again, if you want to know how your money gets spent, going to the board meetings is a good way to find out.

It would really be helpful if you would report problems when you first notice them, so they can get addressed a lot faster. If you wait "a few weeks," and no one else has reported the issue to the management company, then fixing things just takes that much longer.

Beware of the towing company the association had contracted with to tow residents vehicle without any warning. Damn, there was a time someone had parked in my slot...i was furious i could have called the towing company but i didn't do that instead i went around and waited for someone to leave and park on an empty slot...you know why i didn't call the towing i am nice enough to consider how much trouble this person is gonna go through if he/she later comes back to find their vehicle gone and have to come out with few hundred dollars to get it back...I admit I am parking on a red zone but what can i do this village is not providing enough parking for unit owners. I am very upset that the association doesn't have better regulation on parking...residents parked their company vehicle here, residents parked their car and leave it on one spot for weeks and weeks...residents have two slots and they rather park outside and none of them get towed for being inconsiderate. Where in the association documents states that a towing company can just show up here in the village anytime of the day and tow unit owner vehicle...will someone from the association points this out to me. If i would have known the parking issues here in the beginning i wouldn't purchase unit here. i am a unit owner here not a guest and i do pay my dues in time to be treated this way. who is now going to reimburse me for $160.00 i just paid the towing company??? this is very very upsetting situation and that i am very very angry...if i have not seen the towing company about to tow my vehicle i would wake up tomorrow morning to get ready for work just to find out my vehicle got towed...all hell will break loose!!! the association does not have the right to just let towing company come here in the village and starts towing residents vehicle...if that's the case then i demand for the association and the property management to post a sign immediately to each bulding warning residents on what happened to me and that to include no residents should park their company vehicle inside the village and no vehicles to park for weeks and weeks without moving and for other resident to be considerate and use parking slots assigned to them specially to those who have two slots already.

FYI, the red zones are all fire lanes. The fire department requires that we keep the fire lanes open in case a fire engine needs to get into the complex. That's the reason the towing company has permission to tow any vehicle parked in a red zone. You, as a homeowner, have the right to have someone towed if they are parked in your deeded parking space.

Early last evening I attempted to leave the lobby of 303 Philip Dr. and enter the garage area. The door would not open. I then went around to the garage through the front entrance and tried unlocking the door from there. That didn't work either. I then reported this to Jennifer Salizar through after hours answering service. This morning I ran into the same problem and after trying graphite on the lock with no results once more called the after hour answering service to learn that Jennifer already had last nights message and said it could wait until Monday. There are 24 units in this building that are being inconvenienced, especially the handicapped and elderly in this rainy weather. I have Great difficulty with not calling a locksmith now to solve this crazy problem. Not being able to open a door which does not require a key from the lobby. Solution is a simple call to a locksmith. It isn't Sunday after all.

Is this the type of service we are paying $480 per month for?

I want the association to be aware that for the second time there's marlboro pack by my patio. I have taken photos of these two packs and i left it where it landed. it is quite upsetting as whoever that resident is should not in the first place just throw the empty pack outside...have they not heard of garbage can? i am asking for the association to into this as i would not want to see another empty pack be outside my patio and for whoever that resident be aware throwing empty pack outside is littering!!! thank you

I am aware there's discussion about adding or improving parking for residents/guests. I have observed that resident(s) literally parked their own personal vehicle outside and in the afternoon move it in place of company truck that resident drive...parking are already taken just by residents alone. What is not right is for that resident to have the luxury of having a spot already...there are two white trucks always parked along with a white van that just move from one parking to another...would please someone from the association look into this...thank you

You're right -- parking is always an issue here, and people do take advantage. Unfortunately, the association doesn't have the money to pay a person to enforce all the existing parking rules. There is a rule against residents parking commercial vehicles on the street (but only those with company signs on them). Commercial vehicles can be parked in an owner's personal space in the garage, however. If you see a vehicle with signs that regularly parks in a street space, please report it to the management company, along with description and license plate information. If it's parked on the street only occasionally, then it might be a vendor hired by the association. There is a parking committee, in case you'd like to volunteer to be on it (if so, you could contact the management company).

I've been doing some research on changing cable, internet and phone carriers. I am hitting a major road block to this issue. Especially since, I know that I could be saving a ton of money if I were to switch carriers. The major issue I am coming up with is that, the other competitors do not service our specific area. Is this because of the block that has been put on our HOA, due to the new construction, and the prohibition of not putting up new satellite dishes? Can someone make any other recommendations?

Hi everyone,

I intend to request the list of homeowners who has NOT paid the following to our HOA as of today:

1. Special assessment for construction for $50K (which was already done before)
2. all the overdue HOA fees/dues

Based on California laws, HOA is allowed to initiate foreclosure process to collect such debts. Are we doing that or not in Serramonte?

As such, I intend to find out the status of collection proceedings done by our HOA/Board to collect all such delinquent debts along with interest and legal fees.

I do not have to pay HOA dues and special assessments for others who avoid making such payments to our HOA by themselves.

I would like to hear thoughts of everyone on that matter asap.

I AM INTERESTED IN KNOWING HOW MANY OWNERS AGREED WITH THE BOARD'S DECISION TO NOT ALLOW THE CLUB HOUSE TO BE USED FOR PERSONAL FUNCTIONS BY OWNERS. I AM WELL AWARE OF THE PAST HISTORY AND THE PROBLEMS CREATE BY SOME OWNER AND THEIR CHIDLREN AND GUEST. HOWEVER SHOULD WE ALL BE PUNISHED FOR THE ERRORS OF A FEW. A REASON FOR PURCHASING IN THE VILLAGE IS THE AVAILABILITY OF A CLUB HOUSE. WE SHOULD REASONABLE RULE FOR USING THIS BUILDING.

Hello, Johnny - Thanks for your input. The use of common area is actually governed by the board via the Rules and Regulations. The board voted several years ago to restrict the use of the rec room to meetings and association-sponsored events. I don't know how many owners agreed with the decision, but hardly anyone ever even asks about it. This is not to "punish" anyone, but to protect our common area. In speaking to other associations' board members, we have learned that this is very common. I haven't been able to find one that does allow it, and they all tell similar stories to ours.

If someone is having a party with more guests than their unit will accommodate, then it's a number of people who will have no place to park legally. If they park illegally, then they create a safety hazard by blocking fire lanes or parking in assigned owners' parking spaces, from which they are likely to be towed. This causes bad feelings and has even endangered the towing company's employees from time to time.

It is certainly a possibility that the board could once again consider renting the rec lounge; but if so, it's possible the requirements would need to include the homeowners' hiring of valet parking, as well as paying the association for security guards during the function, having a board member on call in case of emergency, paying a very high fee and deposit to cover cleaning and damage, and supplying a certificate of liability insurance naming the association as an additional insured. And, of course, none of those things would take back the ruined evenings or afternoons of the surrounding buildings' residents.

Personally, I believe that the random rental of this facility has gone the way of an older set of values in the world, where no one locked their doors -- as sad as that is. I don't know whether you're aware of this, but when it was available for rental, almost all (not just a few) the functions got out of hand and interfered with other homeowners' quiet enjoyment of their homes, ending with the police being called by other residents. One of the last ones was so bad that people were getting into fist fights in the courtyard outside the lounge; and that was supposed to be a children's birthday party!

It appears to me that if the party is too large or too unwieldy for an owner's unit, then it's really too large and unwieldy for the neighborhood. It's almost as if people thought "I don't want to mess up my unit, but I don't care if I mess up the rec center."

There is a spacious building at Gellert Park (our neighborhood polling place) that is available for rental, and it has a huge parking lot right in front. The association rented it when we used to have larger turnouts at our annual meetings (before reconstruction). That seems like a good alternative, considering.

Johnny, your opinions are valuable and appreciated. If you'd still like for the board to reconsider this rule, please let me know.

We finally got gates installed. That is great! But I think, $50.00 for a key is way too much! Is it a key for Mercedes with chip in it? And why we should have two remote openers per unit and only one key?

The board voted last Tuesday at the board meeting to charge $10 each for extra keys, and then $15 for replacement keys if someone loses a key.
